The Kumasi High Court 5, presided over by Justice Dorinda Smith Arthur, has adjourned to October 28 the hearing of an injunction application filed by Akosua Serwaa, who is seeking legal recognition as the only surviving spouse of the late music legend Charles Kwadwo Fosu, popularly known as Daddy Lumba.

In her application, Akosua Serwaa is asking the court to declare her as the lawful and surviving wife of the late musician and affirm her exclusive right to perform widowhood rites.

She is also seeking an order to restrain the head of the Lumba family, Kofi Owusu Fosu, from recognising or engaging with the second defendant, Priscilla Ofori Atta (also known as Odo Broni), as Daddy Lumba’s spouse. Additionally, she wants the court to prevent Odo Broni from publicly presenting herself as the musician’s widow.

During Thursday’s sitting, counsel for the first defendant challenged the legal capacity of the plaintiff and urged the court to determine that issue before proceeding with the main case.

Justice Dorinda Smith Arthur noted that appearance applications had also been filed by the parties and directed all lawyers to submit their responses and related applications by October 28.

The presiding judge further advised both parties and their families to consider an amicable resolution, stressing the importance of preserving the late Daddy Lumba’s legacy and national image.

The case, which has drawn widespread public interest, will continue later this month.
